. Consent Agenda Item l.b Case No. 7-06CW072: Application ofCRV-lndian Shadow Preserve, L.P. Application Summary . This is an application for conditional storage water rights, ground water rights, change of water right, and approval of a plan for augmentation, including appropriative right of exchange in La Plata County near the Town of Hesperus. Applicant seeks the following: I. Conditional storage water rights for CRY Lake Nos. 1-4 for an aggregate amount of 30 acre-feet for agricultural, commercial, irrigation and municipal uses that include domestic, irrigation of lawns, gardens and parks, fire protection, recreational, wildlife, piscatorial, lake and reservoir evaporation, augmentation and replacement, exchange, use as a substitute supply, and to meet replacement, return flow or other obligations related to other decreed water rights. The application identifies the La Plata River alluvium as the source to fill the lake, and also mentions the Keller Ditch. However, it is not clear if the Keller Ditch will be used to fill the lakes. 2. Ground water rights for CRV Well Field (up to 5 wells and/or infiltration galleries) for a total of I cfs for the same uses and with the same appropriation date as above. 3. A change;Qfwater right for 0.25 cfs of the 1.25 cfs of the Brown Brothers Ditch (No.2 Priority) from irrigation to the uses described above. The water for this ditch is currently diverted at the La Plata Irrigating Ditch headgate. 4. Approval of a plan for augmentation to replace out-of-priority depletions that result from out-of-priority pumping of the CRV Well Field for uses within the Indian Shadow Preserve development. The application indicates that up to 25 acre-feet annually of consumptive use credits of dry-up associated with the Brown Brothers Ditch will offset the new consumptive uses. The Applicant's proposed plan for augmentation may injure the Board's instream flow water rights on the La Plata River by not replacing out-of-priority depletions in time, place and amount.
