Div. 1, DAMID: 060307 <br /> <br />Dear Ms. Law & Mr. Moy: <br /> <br />As you know, on September 2, 1994, I performed a dam safety inspection on the subject <br />dam in accordance with Section 37-87-107, Colorado Revised Statutes (1991 Repl. Vol.), This <br />statute assigns to the State Engineer the responsibility for the determination of the safe storage <br />level for the reservoirs within Colorado, and provides the authority to drain reservoirs which are <br />found to be unsafe. At the time of the inspection. the dam was observed to have a number of <br />problems which, if left unattended, could ultimately lead to its failure. <br /> <br />Since the 1994 inspection, progress to rectify the identified safety deficiencies at the dam, <br />as verified by periodic follow-up inspections, has been very slow at best. In order to ensure that <br />this does not continue unabated, I feel that it is necessary to impose a time limit for <br />accomplishment of measurable progress at enhancing the safety of the structure. Therefore, I am <br />requiring that a work plan for improving the safety of the dam, in the areas described by my 1994 <br />report, be submitted by your engineer to this office for review no later than December 31, 1997, <br />Additionally, the remedial work. on the dam will need to be comPlet~ No~ember 30, ) 998.:.J <br />Failure to meet these dates will result in a restriction being placed on t e reservoir to ensure its <br />safety, <br /> <br />Please bear in mind that the plans and specifications for the repair of the dam will ne~d to <br />be approved by our Denver office in advance of construction, and that the review may statutorily <br />take up to 180 days. I can provide you with whatever intormation you need on how to prepare an <br />acceptable set of design documents per the Dam Safety Rules. <br /> <br />In the meantime, water should not be stored in the reselVoir in excess of the level of the <br />lowest spillway overflow pipe, as this reduces the already nominal freeboard and aggravates the <br />existing seepage problem. The use offlashboards to raise the lake level'is not allowable, <br />
