It should be noted that the Upper Eagle Regional Water Authority and Vail Associates have filed a statement of opposition to the Board's instream flow filing (Case No. 92CW286) on the IS-mile reach of the Colorado River. Glenn Porzak of Holme, Roberts & Owen, the attorney for the applicants, has informed us that the water rights application in 92CW340 is a basis for the statement of opposition. The Board has not filed a statement of opposition in 92CW340 or in an application by the Authority, the District, Vail Associates and Cyprus Climax for a second enlargement of Eagle Park reservoir in Case No. 93CW30 1. The total cost of the project depends upon the extent to which the four participants make use of or purchase facilities and water rights owned by Cyprus Climax. The $12.5 million cost figure is a maximum amount based upon the terms of an existing agreement between Vail Associates and Cyprus Climax. The applicants have indicated they would like to request the approximately $12.5 million in funding in amounts of about $3.0 million to $4.0 million per year over a period of several years. A very detailed loan application has been submitted and the staff is presently working with the applicants and their consultants to complete the feasibility analyses. No Board action is requested at this time.
