<br />"" . <br /> <br />requirements. The remaining 44.4 acres of land3 irrigated under the Heinze <br />Ditch will continue to be irrigated in the following manner. Up to 13 acres <br />will continue to be irrigated within the correctional facility. In addition, up <br />to 11 acres of the historically irrigated lands within the land application <br />area will continue to be irrigated as effluent support to assure that adequate <br />water is available in dry years for the land application area crop. In the <br />event the water is not needed for such effluent support, the water will be <br />used on other lands historically irrigated by the Heinze Ditch or the <br />consumptive use credits associated with the water will be stored in RCC <br />Reservoir NO.1. The water associated with the remaining acres will <br />continue to be used to irrigate lands historically irrigated by the Heinze <br />Ditch priorities or the consumptive use credits associated with the <br />remaining acres will be stored in RCC Reservoir NO.1. The location of the <br />dry up acreage, including both the 8.1 acres dried up to satisfy the W-3758 <br />decree and the 18.8 acres for this decree, and the remaining acreage are <br />illustrated on Appendix II. <br /> <br />13.2. RCC Reservoir No. 1 is an off-channel reservoir located in the E ~ SE 1f4 <br />SW 1f4 of Section 36, T 4S, R 93 W of the 6th P.M. in Garfield County, Colorado. <br />The releases from the reservoir may be composed of water stored in the reservoir <br />pursuant to a decree to be issued in Case No. 96CW363, Water Division 5, <br />pursuant to the change of water rights for the Heinze Ditch which is included in <br />this First Amended Application, and any seepage from the reservoir. <br /> <br />14. Changes granted: The Applicants are permitted to add new uses to the portions of <br />Priority No. 67, Priority No. 102 and Priority No. 125 of the Heinze Ditch water rights <br />which were not changed by Case No. W-3758 for use at the expanded Rifle Correctional <br />Center and Rifle Gap State Park for domestic, sanitary, irrigation, including irrigation by <br />reuse and successive use of treated wastewater, industrial, stock watering, commercial, <br />mechanical, recreational (including fish and wildlife), horticultural, fire protection, storage <br />and subsequent application to beneficial uses, exchange purposes, and for the replacement <br />or augmentation of well pumping depletions, as authorized by the decree entered in Case <br />No. W-3758 or this decree. In addition the Applicants have the statutory right to sell, <br />lease or exchange such water pursuant to C.R.S. 99 17-24-106(1)(k) and 37-88-101, et <br />seq. The Applicants can withdraw the amount of water needed for the increased water <br />uses by the Rifle Correctional Center and the Rifle Gap State Park above the 13.7 acre- <br />feet per year covered by the Plan for Augmentation decreed in Case No. W-3758 through <br />any combination of the seven wells described more fully in paragraph 11 of this Decree, <br />including any replacement wells. <br /> <br />3 The parties have disputed and the court is making no finding with regard to whether all or a portion of the 44.4 <br />acres of land have been irrigated since 1979 to the date of this decree. However, for the purpose of compromise, <br />the parties have agreed to use a consumptive use figure of 1.35 acre-feet per acre for the remaining 44.4 acres <br />through 1997 for this case and any subsequent case filed regarding the Heinze Ditch priorities 67, 102 and 125. <br /> <br />9 <br />
