<br />.. <br /> <br />3. Timely and adequate notice of the pendency of these proceedings in rem were <br />given in the manner required by law. The Water Court has jurisdiction over the subject <br />matter of these proceedings and over all who have standing to appear as parties, whether <br />they have appeared or not. <br /> <br />4. Timely statements of opposition were filed by the following: <br /> <br />4.1. Ray D. Walker <br /> <br />4.2. Puma Paw Ranch, Inc., Douglas and Barbara Sheffer <br /> <br />4.3. W. F. Clough <br /> <br />4.4. Colorado Water Conservation Board <br /> <br />On August 11, 1999, the Court granted an Order substituting Puma Paw, LLC for <br />Puma Paw Ranch, Inc., Douglas and Barbara Sheffer as a party in interest in this case. <br />The time for filing Statements of Opposition and for seeking leave to intervene has <br />expired. <br /> <br />5. The Division Engineer for Water Division 5 issued his Summary of Consultation <br />on July 16, 1998 and November 23, 1998. The November 23, 1998 Summary of <br />Consultation recommended that the issues discussed in that Consultation be addressed <br />prior to the granting of any water rights or plan for augmentation. <br /> <br />6. On July 13, 1999, the Referee Re-Referred this case to the Water Judge. <br /> <br />7. The land and water rights involved in the augmentation plan are not included <br />within the boundaries of any designated ground water basin. <br /> <br />8. The Applicants have proceeded with diligence in performing the necessary <br />engineering, obtaining information, gathering evidence, and reaching accommodations <br />with the various Opposers in connection with the prosecution of this case before the <br />Water Court. <br /> <br />9. The Applicants have reached Stipulations with the following Opposers: <br /> <br />9.1 The Applicants reached a Stipulation with Opposer Ray D. Walker on August <br />23, 1999. On August 24, 1999, the Court issued an Order approving the <br />Stipulation between the Applicants and Opposer Ray D. Walker. <br /> <br />9.2 The Applicants reached a Stipulation with Opposer W. F. Clough on <br />September 8, 1999. On September 10, 1999, the Court issued an Order approving <br />the Stipulation between the Applicants and Opposer W. F. Clough. <br /> <br />2 <br />
