<br />" <br /> <br />I Be it enacted by the General Assembly of the State of Colorado: <br />2 . SECTION 1. 37-60-126 (2) (a), (5), (7), and (12), Colorado <br />3 Revised Statutes, are amended to read: <br />4 37-60-126. Water conservation and drought mitigation <br />5 planning - programs - relationship to state assistance for water <br />6 facilities - guidelines - water efficiency grant program - repeal. <br />7 (2) (a) V/ithin five yeats after June 4,1991, Each covered entity that docs <br />8 not have a water use efficiency plan satisfying the provisiolls of <br />9 subsection (4) of this section shall, subj ect to section 37-60-127, develop, <br />10 adopt, make publicly available, and implement a plan pursuant to which <br />II such covered entity shall encourage its domestic, commercial, industrial, <br />12 and public facility customers to use water more efficiently. Any cOvered <br />13 cntit} that makes an initial determination that it has satisfied sttbsection <br />14 (4) of this section shall, within five }ears after June 4, 1991, gi\le public <br />15 noti{,c of stich detcrmination at an official meeting of thc appropriate <br />16 gO"VGIlling body of the COvered cntit}. ANY STATE OR LOCAL <br />17 GOVERNMENTAL ENTITY THAT IS NOT A COVERED ENTITY MAY DEVELOP, <br />18 ADOPT, MAKE PUBLICLY AVAILABLE, AND IMPLEMENT SUCH A PLAN. <br />19 (5) Each covered entity AND OTHER STATE OR LOCAL <br />20 GOVERNMENTAL ENTITY THAT ADOPTS A PLAN shall follow the cOvcred <br />21 entity's rules, codes, or ordinances to make the draft plan available for <br />22 public review and comment. If there are no rules, codes, or ordinances <br />23 governing the co v ered entity's public planning process, then each eo v er cd <br />24 entity shall publish a draft plan, give public notice of the plan, make such <br />25 plan publicly available, and solicit comments from the public for a period <br />26 of not less than sixty days after the date on which the draft plan is made <br />27 publicly available.
