The natural stream chmmel at the headwaters of the Arkansas River at <br />latitude 380 26' OO"N and longitude 1060 14' 10"W as the upstream <br />terminus and extending to confluence of Spruce Creek at latitude 380 <br />29' 46"N and longitude 1 060 07' 29"W as the downstream terminus, <br />being a distance of approximately 8.4 miles. This segment can be <br />located on the Mount Ouray and Poncha Pass U.S.G.S. quadrangles. <br /> <br />b. For administrative purposes only: <br />Upper Terminus = NE NW S7 T48N R7E NMPM <br />UTM 4254 413N 13 3 92 110E <br />1980' East of West Section Line, 935' South of North SeCtion Line <br />Lower Terminus = SW SE S18 T49N R8E NMPM <br />UTM 4261 253N 13 401 9l7E <br />2460' West of East Section Line, 1220' North of South Section Line <br /> <br />5. Use of the water: <br />mstream flow to preserve the natural environment to a reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br />January 28,2004 <br /> <br />7. 'The water was first applied to the above beneficial use on January 28, 2004, <br />by the action of the Colorado Water Conservation Board under the provisions of c.R.S. <br />9 S 37-92-102(3) and 37-92-103(3), (4) and (10). <br /> <br />8. Amount ofwater claimed (ABSOLUTE): msteam flow of2.25 cfs (Aprill - <br />August 31) and 1.45 cfs (September 1 - March 31). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of 2.25 cfs <br />(April 1 - August 31) and 1.45 cfs (September 1 - March 31) is hereby entered to <br />preserve the natural environment to a reasonable degree through the stream segment <br />described in paragraph 4 above.
