The natural stream channel at the headwaters of the Arkansas River at <br />latitude 380 46' OO''N and longitude 1050 40' 58"W as the upstream <br />terminus and extending to confluence of Currant Creek at latitude 380 <br />44' 07"Nand longitude 1050 32' 16"W as the downstream terminus, <br />being a distance of approximately 10.1 miles. This segment can be <br />located on the Black Mountain, the Dicks Peak, and the Thirtyone Mile <br />Mountain U.S.G.S. quadrangles. <br />b. For administrative purposes only: <br />Upper Terminus = NW NW S9 T15S R74W 6PM <br />UTM 42 90 900N 13 4 40 682E <br />640' East of West SeCtion Line, 0' South of North Section Line <br />Lower Terminus = SW NW S23 T15S R73W 6PM <br />UTM 42 87 337N 13 4 53 263E <br />160' East of West Section Line, 1910' South of North Section Line <br /> <br />5. Use of the water: <br />Instream flow to preserve the natural enviromnent toa reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br />January 28, 2004 <br /> <br />7. The water was first applied to the above beneficial use on January 28, 2004, <br />by the action of the Colorado Water Conservation Board under the provisions of C.R.S. <br />S S 37-92-102(3) and 37-92-103(3), (4) and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Insteam flow of 1.0 cfs (April 15 <br />- May 14), 0.50 cfs (May 15 - October 31), and 0.35 cfs(November 1 - April 14). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of 1.0 cfs <br />(April 15 - May 14),0.50 cfs (May 15 - October 31), and 0.35 cfs (November I - April <br />14) is hereby entered to preserve the natural environment to a reasonable degree through <br />the stream segment described in paragraph 4 above. The appropriation date for this water <br />right is January 28, 2004. <br /> <br />2 <br />
