PRE HEARING ORDER

A prehearing conference for the contested proposed instream flow appropriations on Smith Fork
Gunnison River and South Smith Fork Gunnison River was held in this matter on September 15,
2006 at 8:30 a.m. at the Colorado Department of Law, 1525 Shennan Street, Denver, Colorado.
The purpose the prehearing conference was to establish an agenda for the hearing before the
Colorado Water Conservation Board (CWCB) and resolve any procedural issues prior to the
hearing. In attendance at the prehearing conference, either by telephone or in person, were
Hearing Officer Casey Shpall; Amy Stengel, Todd Doherty and JeffBaessler for CWCB staff;
Drew Peternell for Trout Unlimited; Dixie Luke for Ragged Mountain Water Users Association,
Dave K.anzer for the Colorado River Water Conservation District.

All Parties that participated in the prehearing conference indicated that they had no outstanding
issues with the proposed instream appropriations for the Smith Fork Gunnison River and South
Smith Fork Gwmison River. Therefore, the Hearing Officer recommends that the Smith Fork
Gunnison River and South Smith Fork Gwmison River be placed on the CWCB' s regular agenda
for hearing at the November 2006 meeting but that no testimony be taken. The hearing will be
held in conjunction with the CWCB's meeting on November 13-15,2006, at the Red Lion Hotel,
4040 Quebec Street, Denver, Colorado.
