All water diverted into the Oxbow/floodplain Fish Habitat Improvements will be returned <br />to the Blue River approximately 1.1 miles downstream of the diversion. <br /> <br />Except for a small amount of evaporation, the Oxbow/floodplain Fish Habitat Improvements will <br />be virtually non-consumptive. Although evaporative depletions occurred from the Oxbow <br />historically, S.G. Company has nonetheless included replacement of evaporative losses from the <br />Oxbow/Floodplain Fish Habitat Improvements in the augmentation plan that is the subject of Case <br />No. 04CW238. The use of water consumed will be for evaporative losses from the 3.6 acres of <br />ponds and 1.25 acres of wetlands that are part of the Oxbow/Floodplain Fish Habitat Improvements. <br />The amount, timing and frequency of potential injury to the ISF due to diversion of water into the <br />Oxbow/floodplain Fish Habitat Improvements is identified in Appendix N. <br /> <br />Description of Mitigation: <br /> <br />Mitigation offered in exchange for the proposed injury is provided primarily by the private funding, <br />installation and continued maintenance of 3.5 miles of river restoration in the Blue River Channel <br />(the "Blue River fish Habitat Improvements"). The Blue River Fish Habitat Improvements have <br />been completed and are represented on the project map in Appendix I. Mitigation includes 3.5 miles <br />of river restoration that utilized private funding to place over 8000 boulders into 172 structures (85 <br />instream rock habitat clusters, 21 bank placed rock habitat clusters, 35-30 degree upstream rock <br />groins, 16-thalweg J hooks, 10 cross channel W Werrs, and 8 cross channel low rock thalweg vanes) <br />on the Blue river in the location of the proposed injury. The Blue River Fish Habitat Improvements <br />also included reshaping and deepening of the channel to provide a lower width-depth ratio. The <br />Oxbow Reach proposed for this agreement contains roughly one third of the Blue River Fish Habitat <br />Improvements. Every effort has been made to minimize this injury including development of an <br />augmentation plan for replacement of the depletions caused by the Oxbow/Floodplain Fish Habitat <br />Improvements as well as development of a flow-sharing agreement that assures the river has <br />adequate water to allow the CWCB to "protect the environment to a reasonable degree". The <br />proposed flow-sharing agreement is attached as Appendix m. Additional terms and conditions of <br />this injury with mitigation proposal are set forth in Appendix V. <br /> <br />The Blue River Fish Habitat Improvements are already constructed and are in place and have <br />substantially improved the hydraulic conditions of the Blue River and increased the ability of the <br />Blue River to protect aquatic biotic and the natural environment to a reasonable degree with lower <br />flows. Monitoring has provided insights for the CWCB's consideration relative to the function of <br />these improvements in helping the CWCB continue to protect the environment ofthe Blue River to <br />a reasonable degree with lower flows. <br /> <br />Evaluation of Proposed Alternatives to Provide Full Protection to the ISF: <br /> <br />The Oxbow//Floodplain Fish Habitat Improvements require a continual source offlow-through water <br />to maintain the biotic benefits to the river provided by this project.
