<br />. <br /> <br />. <br /> <br />e <br /> <br />PROPOSED FLOW-SHARING AGREEMENT: <br /> <br />1. When the diversion of 10 cfs of flow from the Blue River via the High-Miller Ditch <br />to the Oxbow/Floodplain Fish Habitat Improvements would reduce the flow of the <br />Blue River below the decreed ISF amount, after accounting for the average monthly <br />consumptive use flow rate from the Peabody No.1 Ditch water rights (the "Peabody <br />No. 1 Ditch Flow Rate Contribution") that are the subject of Case Nos. 05CW264 <br />and 05CW265 that will be left in the river to supplement the CWCB' s 125 cfs <br />irrigation season (May through September) ISF, and a flow-sharing agreement shall <br />be implemented as follows: <br /> <br />a. All diversions to the designated off-channel oxbows that are part of the <br />Oxbow/Floodplain Fish Habitat Improvements shall cease during out-of- <br />priority periods when river flows are less than or equal to approximately 85% <br />of the existing ISF plus the Peabody No.1 Ditch Plow Rate Contribution for <br />the time period. As such, diversions to the Oxbow/Floodplain Fish Habitat <br />Improvements shall cease when the following thresholds offlow occur in the <br />Blue River: <br /> <br />May <br /> <br />105 cfs (ISF: 125 cfs / Peabody No.1 Ditch <br />Flow Rate Contribution: 0.0 cfs) <br />105.5 cfs (ISF: 125 cfs/PeabodyNo. 1 Ditch <br />Flow Rate Contribution: 0.5 cfs) <br />105.4 cfs (ISF: 125 cfs /PeabodyNo. 1 Ditch <br />Plow Rate Contribution: 0.4 cfs) <br />105.2 cfs (ISF: 125 cfs / Peabody No.-l Ditch <br />Flow Rate Contribution: 0.2 cfs) <br />105.1 cfs (ISF: 125 cfs / Peabody No.1 Ditch <br />Flow Rate Contribution: 0.1 cfs) <br />74 cfs (ISP 90 & 85 cfs) <br /> <br />June <br /> <br />July <br /> <br />August- <br /> <br />September <br /> <br />October - April <br /> <br />b.
