If the operation is a commercial project. the director shall set a fee that is sufficient
to pay the direct costs of review of the permit application. public hearings regarding the application.
and monitoring of pcnnit operations under this article. Said fees are intended to provide at least a
portion of the moneys necessary to administer this article. Said fees shall be deposited into the
Colorado water conservation board construction fund created in section 37.60.121. C.R.S. SAID
FEES ARE HEREBY CONTINUOUSLY APPROPRIATED TO THE BOARD FOR PURPOSES
ESTABLISHED BY THIS SECTION.

J)j\cussion

This statute revision simply gives the Flood Protection Section spending authority to expend the
funds received through permit fecs from the Weather Modification Program. The Legislature
appropriated S75,000 in US 06-1313 for the CWeB to assist water providers with the development
of cloud seeding programs that provide benefits to recreation. streams, and reservoirs through
snowpack enhancement. The same legislative action also allowed the Section to accept, allocate
and expend contributions and donations of money, property and equipment to carry out the purposes
of the Program. This minor statute change allows the Section to spend the Program's final defined
revenue source in carrying out the Weather Modification Program activities.

Flood I'rottochOn .
