Report from the Director of Compact Negotiations

. A framework and principles to guide negotiations
between Basin Roundtables, including policies to
ensure that individual compacts do not conflict with
one another;

. Procedures for ratification of compacts, including a
mandatory provision that every affected Basin
Roundtable must approve the draft compact;

. Authorities and procedures to ensure that approved
compacts are legally binding and enforceable; and

. Procedures for integrating the Interbasin Compact
processes with other water planning and development
processes, except that no provision may supersede,
impair, or modify any local government's "authority,
jurisdiction, or permitting powers."

1.4.4 IBCC By-laws

On June 30, 2006, the IBCC approved a set of Bylaws
governing its actions; including a procedure whereby
Basin Roundtables that opt out of the process are no
longer represented on the committee but may opt back
in, as required by the legislation.

The By-Laws are included in Appendix F and contain:

. Reference to the roles outlined in the Charter and the
requirement to provide an annual report to the
Legislature;

. Definitions of key term included in the bylaws;

. Committee membership and leadership, including use
of alternates and proxies, and procedures for Basin
Roundtables opting out of or back into IBCC
membership;

. Meetings of the committee, including regular and
special meetings, notice of meetings, attendance and
use of teleconferencing, and the definition of a
quorum;

. Procedures for decision making, which mirror the
procedures contained in the Charter and seek to
obtain a broad level of support for any action where
possible;

. Protocols for establishment of working groups,
including membership and responsibility to the IBCC
as a whole; and

. A process for amending the bylaws, through which
members may raise possible revisions and
amendments at any time, with the committee
following the decision making process outlined in the
bylaws for review and approval of any modifications.

The IBCC held eight meetings prior to the submission of
this report, beginning on February 3, 2006. The
committee successfully drafted a Charter and Bylaws,
established working groups, discussed a variety of
topics, and heard presentations from Basin Roundtables
and others.
