IID JMIll'1I'
For Negotiation Purposes

.

that failure to meet the monetary obligations owed to PRRIP may result in
suspension of PRRIP benefits and possible regulatory action by federal
agencies against Colorado, or water users within Colorado, under the ESA.

d. Human Resources. PRRIPCA contemplates that Colorado's interests will be
represented by two members of the Governance Committee: One member is to be
selected by the State of Colorado and one is to be selected by SPWRAP. The
Parties will consult with each other regarding the selection of these Governance
Committee members.

Colorado and SPWRAP will continue to cooperate in the formulation of
Colorado's positions on the implementation of the First Increment as well as
the components of any later increments.

11 During the process of negotiating the PRRIP, a number of individuals with
relevant expertise have been made available by DNR, and by SPWRAP and
its members. To the extent they believe they are able, DNR, SPWRAP and
members will continue in the future to provide persons with such expertise to
assist with negotiations, provide information and counsel to Governance
Committee members for Colorado and the Colorado water users, and to
participate on advisory committees ofPRRIP.

.

III At various times during the development of the PRRIP, Colorado water users
have, at their own expense, met with federal legislators and natural resource
agencies to urge them to continue and/or increase the federal portion of the
funding needed to operate the PRRIP. SPWRAP will continue such efforts as
appropriate, and the Parties will coordinate in that regard.

IV Activities in Colorado to meet PRRIP obligations add further demands for
human resources beyond those needed during the negotiation and
development of PRRIP. Some of these demands may be met through
consultants or other independent contractors; others may be met through use
of employees of Colorado or of SPWRAP members. Further agreements
between the Parties regarding how these human resources demands will be
met may be necessary.

.

e. Accounting. The PRRIPCA requires Colorado to account for the water it re-
regulates for program purposes, and requires collection and reporting of data
pertaining to population growth, water sources being relied upon for supplying
new growth, the acreage of irrigated agriculture and other matters. The Operating
Committee will develop and propose a process for collecting and analyzing
relevant data and reducing it to a form suitable for submission to the Governance
Committee. SPWRAP will require its members to report: I) on the sources of
water on which they rely; and, 2) any other information requested by the
Operating Committee. The parties acknowledge that the effort required to
develop the accounting process will be substantial, and that in order to ensure its

5

SPWRAP-DNR MoA 08-14-06
