<br />i' <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />Ji <br /> <br />Center of Biodiversity et al. vs. Interior and Reclamation Settlement: In August, the United States <br />and the Center for Biological Diversity entered into a stipulation resolving the lawsuit involving Glen <br />Canyon Dam and the Adaptive Management Plan. The parties that filed motions to intervene, including <br />the Colorado Water Conservation Board, stipulated to the agreement as well. This item will be discussed <br />further in the Report of the Office of the Attorney General. <br /> <br />Catskill Mtns v. NYC - City's Petition for Rehearing Denied: The Second Circuit Court of Appeals <br />issued its decision in Catskill Mountains Chapter of Trout Unltd. v. New York City on June 13,2006 (No. <br />03-7203), which upheld its earlier decision that NYC's water transfer is subject to NPDES permitting <br />under the Clean Water Act. NYC petitioned for rehearing, which the court denied in an order dated <br />August 25. <br /> <br />NYC's petition for certiorari is due to the Supreme Court on or about Thanksgiving. Amicus briefs will <br />be due just before Christmas. <br /> <br />Homeland Security and EPA Officials Address Water Security Congress: As the rest of the nation <br />marked the 5th anniversary of 9/11, Robert B. Stephan, Assistant Secretary for Infrastructure Protection <br />for the U.S. Department of Homeland Security (DHS), and Benjamin H. Grumbles, Assistant <br />Administrator, Office of Water for the U.S. Environmental Protection Agency (EPA), spoke to the fourth <br />Water Security Congress, hosted by the American Water Works Association (A WW A) in Washington, <br />D.C., September 10--12. <br /> <br />The Water Security Congress, at Washington's Omni Shoreham Hotel, brought together water utility <br />managers from across the country with national security experts, emergency responders, and public <br />officials to address the essential need for the continued safety and security of the country's water supply. <br /> <br />Mr. Stephan discussed the National Infrastructure Protection Plan (NIPP) and highlighted the agency's <br />collaboration with the water industry through the Water Sector Coordinating Council (WSCC). Mr. <br />Grumbles provided the EPA's perspective on the latest issues affecting the water industry. <br /> <br />The Water Security Congress focused on water supply issues before, during and after natural disasters, <br />terrorist attacks or other water emergencies. Topics included mutual aid agreements for water utilities - a <br />growing area of interest in the aftermath of hurricanes Katrina and Rita -- monitoring for contaminants, <br />vulnerability assessments, emergency preparedness exercises, and emerging technologies in water <br />security. The Congress also provided an opportunity to discuss best practices and share ideas about how <br />to better protect the public. <br /> <br />Reclamation Hosts Public Meeting for Managing for Excellence Project: The Bureau of Reclamation <br />is holding a meeting to inform the public about the Managing for Excellence project on September 19 <br />and 20 in Salt Lake City, Utah. This meeting is the second of three meetings in 2006 to inform the public <br />about the action items, progress, and results of the project and to seek comments. <br /> <br />The Managing for Excellence Project will identify and address the specific 21st Century challenges <br />Reclamation must meet to fulfill its mission "to manage, develop, and protect water and related resources <br />in an environmentally and economically sound manner in the interest of the American public." <br />To find out more about the Managing for Excellence Action Plan, please visit the website at: <br />www.usbr.gov/excellence . <br /> <br />Reclamation Sponsors Research Aimed at Measuring Evaporation: On August 15 federal water <br />officials reported that a research project under way along the Rio Grande near Albuquerque, NM could <br />lead to more accurate estimates of natural evaporation losses along the river; including a development that <br />would lead to improved river modeling. <br /> <br />5 <br />
