<br />. <br /> <br />City Manager Bob Ledger said the $75,000 brings the total appropriated so far to $193,700. The money <br />pays lawyers' fees and fees for experts who are preparing information, data and graphics, advise on the <br />design of permanent structures in the boating park and will testify at trial. <br /> <br />He predicted that if they continue on the track they are, they will need perhaps another $200,000 in 2007. <br />He said the nearly $400,000 total price tag appeared to be the going rate in such cases. A 10-day Durango <br />water court trial is set for May 2007. <br /> <br />Status of Proposed Pine River Water Acquisition:: In July 2006, the Pine River Irrigation District <br />(PRID) and Southern Ute Indian Tribe submitted a proposal to the CWCB to donate water stored in <br />Vallecito Reservoir for the purpose of preserving and improving the natural environment of the Pine <br />River. The proposed Donation Agreement was presented to the CWCB for formal consideration at the <br />July 2006 Board meeting in Durango. Pursuant to Rule 6 of the ISF Rules, the Board has 120 days from <br />the date of that Board meeting to determine whether or not to accept the proposal, unless further time is <br />granted by the requesting person. <br /> <br />. <br /> <br />At the July CWCB meeting, members of the public and Board members raised questions regarding certain <br />proposed terms in the agreement. Staff has met with the donors on two occasions since the July Board <br />meeting, and have made some changes to the agreement. The revisions correct clerical errors in the listed <br />monthly donated flow amounts (Paragraphs lR and IS), clarify the use of the donated water to improve <br />the natural environment (Paragraph 2E), clarify that the Board will not be assessed "0 & M" charges for <br />Val1ecito Reservoir (Paragraph 7G), and strengthen the contract language in Paragraph 7F. The PRID <br />Board has already approved the proposed Donation Agreement, and CWCB staff expects consideration <br />and approval by the Southern Ute Tribal Council sometime in September or October. As a result, final <br />CWCB consideration of the proposed Donation Agreement has been postponed until the November 2006 <br />Board meeting in Denver. Additional information about the proposed water donation on the Pine River, <br />including the revised proposal, can be found on the CWCB web site at <br />http://www.cwcb.state.co.us/Streamandlake/acquisitionNotices.htm <br /> <br />The CWCB has 120 days to In September 2005, staff presented an overview of the water donation <br />proposal to the CWCB board members in Durango. At that meeting, representatives from PRill and the <br />Tribe expressed support for the "water donation" approach, and local interests also presented comments <br />and concerns to the CWCB board members. Following that meeting, staff met with representatives from <br />PRill and the Tribe to review and revise the latest draft of the agreement. All parties seemed confident <br />that the agreement was close to final form, and anticipated presenting the proposal to CWCB for initial <br />consideration at its January 2006 meeting. <br /> <br />In November, the Tribe held Council elections. The Tribal Council will need to approve the donation <br />agreement before it can be considered by CWCB. Staff recently received a letter from the Tribe <br />requesting that consideration of the donation agreement by CWCB be postponed until after the new Tribal <br />Council has had a chance to meet and become familiar with the proposal. The new Council is expected to <br />meet in late January and again in February. If approved by the Council, CWCB staff expects to present <br />initial consideration of the proposal at the March CWCB meeting. <br /> <br />Yampa/White River Basin <br /> <br />. <br /> <br />Yampa WCD Asks for Feedback on Stagecoach Work: By raising the elevation of Stagecoach <br />Reservoir by four feet, the Upper Yampa Water Conservancy District can ensure there will be enough <br />water to meet future population growth and increased jrrigation needs as well as increased demands from <br />recreational and environmental users. <br /> <br />31 <br />
