<br />- 2 - <br /> <br />developed an after-the-fact agreement for emergency access and repair for their facilities, and CWCB <br />Staff anticipates such an agreement would be appropriate in this potential third scenario within the Project. <br /> <br />Because of the recent events with the City of Englewood and the Littleton Rotary Club, CWCB staff has <br />been working with the Office of the Attorney General to develop generic documents that can be used in <br />these types of situations when they arise in the future. An application would be available via internet to be <br />submitted to CWCB Staff, which will serve to put the applicant on notice of the requirements to obtain <br />permission to use Project lands for an event. The signed application, combined with an approval letter <br />from Staffto the applicant, would constitute a temporary access "permit". <br /> <br />Copies of the proposed permit applications for special events and for emergency situations will be made <br />available to the Board members during the Board meeting. The draft applications have been sent to <br />Colorado State Parks, Urban Drainage and Flood Control District, and the US Corps of Engineers for <br />review and comment. We have received extensive input and guidance from the Attorney General's office <br />and have incorporated comments from the partnering agencies in the development of the proposed permit <br />applications. We believe the proposed approach is reasonable and customary. <br /> <br />Staff Recommendation <br />Staff recommends that the Board approve the concept of application forms and letter permits for special <br />events and for emergency operations within the CWCB's right-of-way along the South Platte River, and <br />authorize Staff to grant temporary permits for those uses of the Project lands on a case-by-case basis. <br /> <br />Flood Protection.
