The Company's amended totalloan amount <br />will be $86,050 ($83,750 for the total project costs and $2,300 for the 1 % loan <br />origination fee). Security for the loan will be collateral in compliance with <br />CWCB Financial Policy No.5. The final approval of the loan is conditioned <br />upon the following: 1) Company's Funding Agreement shall include a "step-up" <br />provision. 2) All standard contracting provisions of the CWCB Loan Program <br />including a revised Debt Service Reserve Fund Provision that requires two <br />annual loan payments, one payment set aside at the time of contract execution <br />and one third of an annual payment set aside at the time of each of the first three <br />annual loan payments. Harold Miskel was not present for the vote. The motion <br />was approved unanimously (9-0). <br /> <br />10. Company <br />Tape 2, Track 2 02:14:06 - 02:53:06 <br />Action: A motion was made by Barbara Biggs and seconded by Russell George to <br />approve staff's recommendation that as part ofa two-step injury with mitigation <br />process, the Board make the preliminary determination that the natural <br />environment of the Blue River could be preserved to a reasonable degree under <br />the proposed injury with mitigation if S.G. Company provides the proposed <br />mitigation. The Board also encouraged staff to work with the Water Trust and <br />other interested parties, such as Trout Unlimited, on the proposal. The motion <br />was approved unanimously (10-0). <br /> <br />. <br /> <br />13. Stream and Lake Protection Section - Case Nos. 5-98CW205, 98CW270, and- <br />03CW078 (Upper Eagle Regional Water Authority) <br />Tape 2, Track 3 00:00:00 - 00:01 :42 <br />Action: Staff recommended that the Board discuss litigation strategy for these three cases <br />in Executive Session and authorize the Attorney General's Office, in consultation <br />with CWCB staff: 1) To file petitions to invoke retained jurisdiction in Case Nos. <br />98CW205 and 98CW270, and 2) If the CWCB's motion for new trial in Case No. <br />03CW78 is denied, to file (a) a petition to invoke retained jurisdiction in Case <br />No. 03CW78, and (b) a notice of appeal of the initial action in Case No. 03CW78 <br />with the Supreme Court. Staff further recommended that the Board authorize the <br />CWCB Director to approve the filing of the notice of appeal, as he determines <br />settlement negotiations or other unfolding circumstances may dictate, if the time <br />period for filing a notice of appeal expires before the September Board meeting. <br /> <br />Flood Protection.
