.\ injury with mitigation proposal, provided that the parties have addressed the selective subordination question to the satisfaction of the Division Engineer, and provided that the stipulation contains the agreement of the district to contribute annually to ongoing operation and maintenance costs associated with the gauge in the amount of $5,500 per year, adjusted for inflation annually, indefinitely until relieved by agreement of the CWCB, and the Board will grant relief if the district is no longer using the stipulation to provide the ability to utilize its augmentation plan, with the understanding that district is obligated to utilize the enforcement powers it has to the best of its ability.
