Application Summary

This is an application for conditional water rights for five springs (Lacy Spring Nos. 1-5) and a
conditional storage right for Larkspur Ponds near Crested Butte. Applicant proposes to use the
water so diverted or stored for various uses within the Larkspur Subdivision. The application states
that "Applicant will participate in plan for augmentation decreed in Cases Nos. 02CW294 and
03CW107 by purchasing of augmentation certificates from the Upper Gunnison River Water
Conservancy District. . . ."

augmentation without protective terms and conditions specific to this case may injure the Board's
in stream flow water rights on the Slate River and the East River by not replacing depletions in time,
place and amount.
