<br />"In making these allocations, the Board acknowledges that it is unlikely any entity <br />receiving municipal and domestic will require its minimum allocation for a number of <br />years. Demands will gradually increase,... if such full demand is not asserted for many <br />years, such will not constitute an abandonment of this allocation and such un-demanded <br />water may, during such time be allocated first to municipal and domestic users.. .may <br />thereafter be offered to any other user on such basis as the Board of Directors may then <br />determine." As a result, no municipal water user is required to take a minimum amount of <br />Project Water in a given year. <br /> <br />Pursuant to its contractual arrangements with the District, and in turn through the District <br />contract with the United States for conveyance service from the Fountain Valley Conduit, <br />the Fountain Valley Authority is obligated to make payments based on a schedule that <br />reflects a minimum number of acre-feet of Project water expected to be conveyed in a <br />given year. The member entities are not obligated to use the minimum acre-feet in the <br />schedule, but the minimum annual payment must be equivalent to that associated with the <br />scheduled minimum use. <br /> <br />From 1972 through 1997 Project water allocations for municipal and domestic use have <br />averaged 25 percent of the total allocation, and agricultural allocations have averaged 75 <br />percent of the total allocation for the same period. (copies of allocation records are <br />attached to this report) <br /> <br />It should be recognized that the supplemental water provided from the Project through the <br />District to the various municipal and domestic entities constitutes only a small percentage <br />of their total water supply. All of the municipal and domestic entities requesting an <br />allocation of Project Water have their own decreed water rights as their primary supply. <br />They also own and maintain all of their conveyance facilities, including diversion dams, <br />conduits, canals, and storage and treatment facilities, if any. The District does not have <br />any control over any of the water rights held by these entities, or their conveyance <br />facilities. <br /> <br />Pueblo Board of Water Works and the City of Colorado Springs Utilities Department <br />have provided summaries of their Water Conservation practices, copies of which are <br />attached to this report. <br />
