<br />WHEREAS, the State of Colorado recognizes the value in recovering threatened <br />and endangered species and supports the Program and the Adaptive Management <br />Plan as a measured effort towards this goal. <br /> <br />NOW THEREFORE BE IT RESOLVED that the Colorado Water Conservation <br />Board: <br /> <br />1. Encourages the State of Colorado to: continue to cooperate with the States of <br />Wyoming and Nebraska and the United States Department of the Interior; and, <br />take appropriate actions, such as negotiating an interim cooperative agreement <br />that will allow the States and the federal government to cooperatively lay the <br />foundation for the implementation of the Program until the Program becomes <br />effective. <br /> <br />2. Recommends that the Governor of the State of Colorado sign the Program <br />agreement. <br /> <br />3. Encourages the States of Wyoming and Nebraska and the United States <br />Department of the Interior to sign the Program agreement. <br /> <br />4. Supports the passage of Senate Bill 3611, and any other subsequent legislation <br />that would federally authorize the Program, as well as any other legislation that <br />would appropriate funds for the Program. <br /> <br />5. Continue to work with the South Platte Water Related Activities Program, Inc. <br />("SPWRAP") and develop appropriate Memoranda of Understanding to assure <br />that Colorado will be able to meet its obligations should the Program be <br />implemented. <br /> <br />The motion was approved unanimously (10-0). <br /> <br />22. Stream and Lake Protection Section - Proposed Agreement with Upper Eagle Regional <br />Water Authority and Eagle River Water and Sanitation District <br />Tape 3, Track 1 02: 1 0:02 - 02:39:25 <br />Action: A motion was made by Don Schwindt and seconded by Barbara Biggs to table <br />this agenda item until the September Board Meeting. The motion was approved <br />unanimously (10-0). <br /> <br />23. Stream and Lake Protection Section - Injury with Mitigation - Case Nos. 5-01CW305 <br />and 5-02CW77; Applications of Basalt Water Conservancy District <br />Tape 3, Track 1 02:39:25 -03:31:32 <br />Action: A motion was made by Tom Sharp and seconded by Carl Trick to approve the <br />amended staff s recommendation that the Board 1) Make a final determination <br />that the natural environment of the subject reach of the Roaring Fork River could <br />be preserved to a reasonable degree with the proposed injury or interference if <br />applicant provided the proposed mitigation. 2) Authorize staff and the Attorney <br />General's Office to enter into a stipulation with the District implementing the <br /> <br />Flood Protection.
