The foregoing recitals _ are incorporated herein as findings and <br />determinations of the Town. <br /> <br />2. The forms of the Loan Contract and the Loan Documents, and any <br />changes thereto as may be necessary in the opinion of the attorney for the Town to <br />effectuate the intentions of the parties or to comply with the provisions of <br />applicable law, are hereby approved. <br /> <br />3. The Enterprise is hereby authorIzed and directed to execute and <br />deliver the Loan Contract and the Loan Documents to the CWCS. <br /> <br />4. The Enterprise is authorized to repay the Loan under the Loan <br />Contract to CWCS. The obligation for repayment of the Loan evidenced by the Loan <br />Contract shall be secured solely with water system revenues of the Enterprise to be <br />derived from the provision of services, which obligation shall have parIty with the <br />existing pledge of said revenue pursuant to that certain loan contract executed In <br />1999 between the Enterprise and the Colorado Water Resources and Power <br />Development Authority in the amount of $917,076. <br /> <br />5. All action not inconsistent with the provisions of this Ordinance <br />heretofore taken by the Town or the Enterprise or its officers and otherwise <br />directed toward the executIon and delivery of the Loan Contract and the Loan <br />Documents is hereby ratified, approved and confirmed. <br /> <br />INTRODUCED on May 18, 2004, at which time copies were available to the <br />Council and to those persons in attendance at the meeting, read by title, passed on <br />first reading, and ordered published in full and posted in at least two public places <br />within the town as required by the Charter. <br /> <br />INTRODUCED a second time at a regular meeting of the Council of the Town <br />of New Castle, Colorado, on June 1, 2004, read by title and number, passed without <br />amerl~n~iJP'proved, and ordered published as required by the Charter. <br />"" ~ OF N~,..?" <br />,...' ,,\ ~ .................... frY'" <br />..... 0 "\~.... * .... 0 -:. <br />:: t..:. ..' ....
