<br />v .., <br /> <br />The plaintiffs have raised the issue of whether the District should have held an <br />election pursuant to Amendment One (TABOR) to obtain landowner approval for the <br />loan. The District did hold an election pursuant to the Irrigation District Act of 1921, and <br />formed a water activity enterprise to borrow the money, administer the project and collect <br />revenues to repay the loan. The CWCB entered into a loan contract with both the District <br />and the Enterprise as it has in many similar situations. <br /> <br />There have been several rumors that the CWCB has been sued for Clean Water <br />Act violations and that this suit challenges the Orchard Mesa Check settlement, neither of <br />which have any basis.
