THE WATER REFEREE RULES: The application for change of use is granted for an absolute decree for the following amounts and stream segments: · the unnamed tributary of Big Horn Gulch, 5.0 cfs, May 15th through October 31S\ . Big Horn Gulch (Reach 1), 10 cfs, May 15 'h through October 31 st; . Big Horn Gulch (Reach 2), 15 cfs, May 15th through October 31 st; . Mineral Creek, 15 cfs, May 15th through October 31 st This change of use is granted and a decree is entered for the exclusive use by CWCB to preserve and improve the natural environment to a reasonable degree through the stream segments a.s described in paragraph 6 above. Thtl demand for the delivery of water under this decree is limited to the amount of water available at the original headings of the Carbon Lake Ditch and the historic season of use from May 15th to October 31 st of each year. The Applicant shall install and maintain such measuring devices and keep such records as the Division Engineer may require for administration of this right. It is accordingly ORDERED that this Ruling shall be filed with the water clerk subject to judicial review.
