I
I
j !

Mr. Paul L. McDill
December 8, 1994
Page two

We would expect to be able to address Items b. and c. in some detail at the January Board
meeting and be able to respond to any questions the Board might have regarding alternatives to
the proposed project including but not limited to purchase of the Hay Gulch well field.

Based on recent .telephone conversations with you, it is our understanding that the District is not
currently an enterprise. fund under the requirements of Amendment One. As we mentioned, this
does not preclude the Board from considering or recommending a loan from the Construction
Fund. Prior to entering into a contract with the District, however, it would be necessary for us
to be assured that all Amendment One requirements were satisfied.

We await the results of your deliberations with your board of directors concerning the above'
items. Please call me or Bill Green if you have any questions or if we can be of any assistance.
. ~

_R

William P.
