The <br />Regional Director will use these records to assist in identifying <br />entities which consistently order water which is not diverted. The <br />Regional Director may reduce the entity's deliveries in a subsequent <br />year by the amount of excess flow to Mexico that is attributable to the <br />entity. In making this determination, the Regional Director will <br />consider whether the excess delivery to Mexico combined with all uses in <br />the State for that year would exceed the State's apportionment, the <br />impact of such excess delivery on the water supply available to the <br />Lower Basin States, and the degree of control the entity has over its <br />water. In some cases the entity will be directed to improve its water <br />scheduling techniques, and the Regional Director may impose special <br />requirements on that entity relative to scheduling and use of water that <br />are stricter than those described in these regulations. <br /> <br />S 415.14 Water aualitv. <br /> <br />The United States does not warrant the quality of water released <br />or delivered pursuant to contract and is under no obligation to <br />construct or furnish water treatment facilities to maintain or better <br />the quality of water.
