<br />. <br /> <br />. <br /> <br />Regional Director shall issue to the user, as appropriate, a cease and <br />desist order or an order reducing the user's entitlement. Any such <br />order issued pursuant to S 415.22 will specify the amount of the <br />reduction. If the user disagrees with the Regional Director's <br />determination of nonuse or the amount of the reduction, the user may <br />appeal the decision to the Commissioner pursuant to S 415.22(f). If the <br />Regional Director's determination of nonuse is not rescinded as a result <br />of a successful appeal pursuant to S 415.22, the Regional Director will <br />provide a contract amendment to the user for execution which shall <br />reflect the reduced entitlement. If the user refuses to properly <br />execute the contract amendment, the Regional Director may <br />administratively reduce the user's contract entitlement and the user <br />thereafter will be entitled to divert no more water than is allowed <br />under the reduced entitlement. <br /> <br />(c) DisDosition of recaDtured entitlement. An entitlement to <br />Colorado River water made available as a result of a reduction because <br />of a finding of nonuse will be made available to other water user(s) <br />within the appropriate State, as determined by the Secretary. <br /> <br />(d) Five-vear review of water utilization. The water use of each <br />water user may be reviewed by the Regional Director at 5-year intervals <br />to verify that water is being used in accordance with terms of the <br />contract.
