<br />. <br /> <br />. <br /> <br />S 415.5 Determination of comDosition of Colorado River water. <br /> <br />(a) PurDose and authoritv. This section defines the boundaries <br />of the mainstream and establishes criteria for determining who is using <br />Colorado River water. These regulations are promulgated to assist in <br />the enforcement of the terms of the Decree by prohibiting the use of <br />water obtained from the Colorado River, including water withdrawn by <br />underground pumping, unless such use is in accordance with the Decree <br />and recognized by the Regional Director. <br /> <br />(b) Hvdroloaic continuity between surface water and subsurface <br />water. In accordance with Article I(C) of the Decree, these regulations <br />recognize the hydrologic continuity between surface and subsurface flows <br />along the mainstream within the Lower Colorado River Basin. <br /> <br />(c) Surface Dortion of mainstream. The surface portion of the <br />mainstream includes all water in the river and all water in the <br />reservoirs, lakes, and ponds on the river, adjacent to the river, or <br />directly connected with the river by surface or subsurface means~ <br />Surface water in water courses tributary to the river becomes part of <br />the mainstream at and downstream of the point where the tributary water <br />commingles with water in the river or with water in reservoirs, lakes, <br />and ponds on the river, directly connected with the river, or adjacent <br />to the river by surface or subsurface means. <br /> <br />(d) Subsurface Dortion of mainstream. The subsurface portion of <br />the mainstream is the water beneath the adjacent land surface elevations <br />of the floodplain and the regulatory surface of the Colorado River. The <br />regulatory surface maps delineate the Colorado River floodplain and the <br />regulatory surface. Subsurface water which is tributary to the <br />subsurface portion of the mainstream becomes part of the mainstream at. <br /> <br />12 <br />
