[TJhe General Assembly <br />hereby authorizes the Colorado water <br />conservation board, pursuant to section <br />37-60-122(1) (b). ... to enter into a <br />binding agreement with the secretary of the <br />United States department of the interior to <br />contribute, on a nonreimbursable basis, <br />five million six hundred thousand dollars <br />for the construction of the Ridges Basin <br />dam of the Animas-La Plata project, said <br />sum to be expended from such monies as are <br />or may hereafter become available to the <br />Colorado water conservation board <br />construction fund, and hereby reaffirms its <br />authorization for the Colorado water <br />resources and power development authority <br />to proceed to consider the Ridges Basin dam <br />of the Animas-La Plata project contained in <br />Senate Joint Resolution No.6, passed at <br />the 1982 regular session of the general <br />assembly, with the expectation that the <br />share of the authority for the Ridges Basin <br />dam will not exceed two million eight <br />hundred thousand dollars, which sum is in <br />addition to those sums previously committed <br />by the authority to the Animas-La Plata <br />project. <br /> <br />The split of the $5.6 million between the Board and the <br />Authority was worked out during the course of preparing <br />amendments to S.B. 142 to effect the necessary authorization. <br />The arrangement which was agreed to is set forth in a March 16, <br />1989, memorandum from me to Senator DeNier: <br /> <br />The bill does not actually direct the <br />Authority to provide the $2.8 million. <br />Rather, the Authority's board of directors <br />will commit, by passing its own resolution, <br />to transfer $2.8 million to the CWCB to, in <br />effect, reimburse the CWCB construction <br />fund when the first monies from section <br />37-60-121(6), CRS, are received [this being <br />the $50 million which is to be appropriated <br />to the Board and the Authority over three <br />fiscal years beginning on July 1, 1990J. r <br />am advised that the Authority's legal <br />counsel has concluded that this can be done <br />and that the Authority's board of directors <br /> <br />-2- <br />
