[TJhe General Assembly hereby authorizes the Colorado water conservation board, pursuant to section 37-60-122(1) (b). ... to enter into a binding agreement with the secretary of the United States department of the interior to contribute, on a nonreimbursable basis, five million six hundred thousand dollars for the construction of the Ridges Basin dam of the Animas-La Plata project, said sum to be expended from such monies as are or may hereafter become available to the Colorado water conservation board construction fund, and hereby reaffirms its authorization for the Colorado water resources and power development authority to proceed to consider the Ridges Basin dam of the Animas-La Plata project contained in Senate Joint Resolution No.6, passed at the 1982 regular session of the general assembly, with the expectation that the share of the authority for the Ridges Basin dam will not exceed two million eight hundred thousand dollars, which sum is in addition to those sums previously committed by the authority to the Animas-La Plata project. The split of the $5.6 million between the Board and the Authority was worked out during the course of preparing amendments to S.B. 142 to effect the necessary authorization. The arrangement which was agreed to is set forth in a March 16, 1989, memorandum from me to Senator DeNier: The bill does not actually direct the Authority to provide the $2.8 million. Rather, the Authority's board of directors will commit, by passing its own resolution, to transfer $2.8 million to the CWCB to, in effect, reimburse the CWCB construction fund when the first monies from section 37-60-121(6), CRS, are received [this being the $50 million which is to be appropriated to the Board and the Authority over three fiscal years beginning on July 1, 1990J. r am advised that the Authority's legal counsel has concluded that this can be done and that the Authority's board of directors -2-
