There was concern on the west <br /> <br />slope that their interests would be overwhelmed by the more powerful and <br /> <br />rapidly developing interests of the drier east slope. But western Colorado <br /> <br />was in an unusually strong position because it was represented by the <br /> <br />political power of Congressman Edward T. Tayler, Chairman of the <br /> <br />Appropriations Committee of the House. The western slope interests, were <br /> <br /> <br />thus able to negotiate acceptable protections. First, they obtained from the <br /> <br />Colorado State Planning Board an administrative statement that the <br /> <br />principle of equitable apportionment applied to intrastate projects, such as <br /> <br />the Colorado-Big Thompson. Later, in 1937 this pr inciple was expressed in <br /> <br />statutory form in a law limiting the quantity of water that could be <br /> <br /> <br />transported to the east slope under the Colorado-Big Thompson Project.J-26 <br /> <br />Subsequently, it was reported that this provision unduly constrained the <br /> <br />State of Colorado's bargaining position in negotiations for an inter sta te <br /> <br />Upper (Colorado River) Basin Compact J-27 (the state could argue for more <br /> <br />Colorado River water without such provision) and it was repealed and the <br /> <br />following substituted: <br /> <br />'(Alny works or facilities planned and designed for the exportation of water <br /> <br />from the natural basin of the Colorado River and its tributaries in <br /> <br />Colorado, by any district created under this article, shall be subject to the <br /> <br />provisions of the Colorado River Compact and the Boulder Canyon Project <br /> <br />Act. Any such works or facilities shall be designed, constructed and <br /> <br />operated in such manner that the present appropriations of water, and in <br /> <br />addition thereto prospective uses of water for irrigation and other beneficial <br /> <br />consumptive use purposes, including consumptive uses for domestic, mining <br /> <br />and industrial purposes, within the natural basin of the Colorado River in <br /> <br />-23- <br />
