<br />Origin Statute.J-15 <br /> <br />"Another California area of origin protection plan was enacted in a 1933 <br /> <br /> <br />statute authorizing construction and operation by the state of the Central <br /> <br /> <br />Valley Project. The entire Sacramento .valley was to be the watershed of <br /> <br /> <br />origin from which surplus water would be exported to the water deficient <br />San Joaquin Valley. This statute provides that the area of origin has a <br />prior right to all of the water reasonably required to adequately supply the <br />beneficial needs of the watersheds.J-16 <br /> <br />"There are several differences between the provisions of the 1933 Central <br /> <br /> <br />Va1ley Project Act and the 1931 County of Origin Statute. The latter <br /> <br /> <br />creates a ri~ht of recapture against the users of export water, conditioning <br /> <br /> <br />all export water rights by giving users in the county of origin a right to <br /> <br /> <br />recapture exported water any time the water becomes necessary for the <br /> <br /> <br />development of the county. The Central Valley Project Act however, <br /> <br /> <br />applies only against the operator of the Project, i.e., the State Department <br /> <br /> <br />of Water Resources and (presumptively) the United States Bureau of <br /> <br /> <br />Reclamation. It has no direct relationship to the filings made by the state <br /> <br /> <br />to unappropriated waters. It grants water uses in the watershed of origin a <br /> <br /> <br />priority of ri~ht to appropriate water for a beneficial use, as we1l as a <br /> <br />priority of right, as against export users, to purchase water from the <br />Central Valley Project.J-17 <br /> <br />"In the late 1950's these statutes became the subject of substantial debate <br /> <br /> <br />as California prepared to vote on a constitutional amendment to authorize <br /> <br /> <br />issuance and sale of 1.75 billion dollars in general obligation bonds to assist <br /> <br />-18- <br />
