A provision that legal proceedings brought by the State or Division Engineer <br />to compel compliance with an interstate compact shall be accelerated on the <br />court's calendar. <br /> <br />. Authorizes fines of up to $500 per day for violations as follows: 1) diversion <br />of ground water contrary to a valid order of the State or Division Engineer, <br />in violation of a plan approved pursuant to the rules and regulations adopted <br />by the State Engineer, or otherwise in violation of rules and regulations <br />adopted by the State Engineer to regulate or measure ground water; 2) failure <br />to submit pumping data required by rules and regulations; 3) falsification of <br />pumping data reported or falsification of a power coefficient or power <br />coefficient test; and, 4) interference with any power meter or measuring device <br />or falsification of a record being made by any power meter or measuring <br />device. <br /> <br />. A provision imposing liability on any person required to replace depletions <br />caused by diversions of ground or surface water whose failure to replace such <br />depletions results in the violation of an interstate compact for all direct, actual <br />and necessary expenses incurred by the State of Colorado to remedy such <br />violation. <br /> <br />The bill has now passed both the House and Senate, and is awaiting the Governor's <br />signature. Governor Roy Romer has stated he will sign the bill. (See Appendix A). <br /> <br />3 <br />
