TIle Coordinated AUllmenlation Program will facilitate work between the <br />S~CWAE, CWPDAand AQUA. Olller groups and Individl,lals may also work with <br />SECWAE under these Principles. <br /> <br />2. Individuals or groups, includinll CWPDA alld AGUA. may apply to SECW AE to <br />pIIrchase Rewrn Flow water for U$C in an augmenultion plan or substitute supply <br />plan. Applications must include t~ proposed augmentlltlon or substilU1e supply <br />plan. and mu.,t comply Wilh all Division 2 Groundwater Rules lUld RegulatioDS; all <br />reQ\lirementi arising our of Kansas v. Colorado: all SECWAE Plan Approval <br />St8,Ddard, and ProcedUres. Return Flow Waler Sale Policies, and Augmentation <br />Water Sale Procedures and Application Process; and any U.S, reclamation laws and . <br />regulations, SECWCD principles, policies, procedures and Contract requiremenlS. <br />and other Slale aDd federal laws and regUlations whiCh may appl)'; all as thcy may <br />be amended (together beiug called "Requirements"). <br /> <br />3. Return flow waters from lhe Fryinllllan-Arkallsu Project will be cold annually by <br />the SECWAE. lIlI available. to AOUA and CWPDA and other enllties or individuals <br />(or use in \heir well Augmentation Plans, subj~l to municiplllities' and eligible <br />dllCh companies' (nOle list) first right of refusal to purchase return flows from use <br />of Project Waler allocated annually 10 them.
