Imposes a S500 per-day civil fine for <br />violations of groundwater diversion rules and reporting <br />requirements as well as for interfering with groundwater <br />diversion measuring equipment. Provides for the enforcement of <br />such penalties by the state engineer and division engineers <br />through the attorney general's office. Makes persons <br />responsible for excess groundwater diversions resulting in <br />violations of interstate compacts liable for expenses of the <br />state in mitigating any such violations. <br /> <br />1 Be it enacted by the General Assembly of the State of Colorado: <br /> <br />2 <br /> <br />SECTION 1. Lower Arkansas water management association <br /> <br />3 loan - appropriation. (1) Pursuant to section 37-60-122 (1) <br /> <br /> <br />4 (b), Colorado Revised Statutes, the Colorado water conservation <br /> <br />5 board is hereby authorized to expend up to three million seven <br /> <br />6 hundred fifty thousand dollars (S3,750,OOO) from the Colorado <br /> <br />7 water conservation board construction fund for the purpose of <br /> <br />8 making loans to the Lower Arkansas water management association <br />9 to purchase augmentation water, or the rights to such water, to <br />10 replace out-of-priority depletions to surface water rights and <br />11 to prevent material depletions of usable state line flows in <br /> <br />12 violation of the Arkansas river compact. <br /> <br />13 <br /> <br />(2) Contracts entered into by the Colorado water <br /> <br />14 conservation board pursuant to section 37-60-119 (2), Colorado <br /> <br /> <br />15 Revised Statutes, for loans specified in subsection (1) of this <br /> <br />16 section shall be subject to an interest rate and repayment <br /> <br />J7 period to be determined solely by the Colorado water <br /> <br /> <br />18 conservation board. Pursuant to section 37-60-120 (1), Colorado <br /> <br />19 Revised Statutes, the board shall require such terms and <br />20 conditions in such contr~cts as will ensure repayment of funds <br /> <br />-2- <br /> <br />124 <br />
