<br />.., - I <br /> <br />Chapter 5 <br /> <br />1994 Rules and Regulations on <br />Ground Water Measurement <br /> <br />Enforcement <br /> <br />The Rules and Regulations Governing the Measurement of Tributary Ground Water <br />Diversions Located in the Arkansas River Basin (1994 Measurement Rules) became effective <br />on July 15, 1994. These roles apply to all wells located in the Arkansas River basin with <br />limited exceptions. All wells within the scope of the roles are required to install a totalizing <br />flow meter or have a power conversion coefficient (pCC) detennined. I Annual reporting as <br />to amounts of water pumped each month is also required unless a sworn affidavit is <br />submitted declaring the well to be inactive. Totalizing flow meters must be verified as being <br />in accurate working condition when installed. At a minimum, the accuracy of such meters <br />and power conversion coefficients must be re-verified every four years. All verifications <br />must be completed by persons approved by the State Engineer. <br /> <br />As of Febroary 1, 1996,2,918 wells were in compliance with the requirements of the <br />1994 Measurement Rules. Of these wells, 332 have installed totalizing flow meters, 1,436 <br />have been rated to detennine a power conversion coefficient, and 1,128 were reported as <br />inactive in 1994, with 1,093 being reported as inactive in 1995. Owners of 122 wells have <br />filed paperwork to change the status of their wells to exempt residential use. Fourteen (14) <br />additional well owners have requested cancellation of their well pennits for wells which were <br />never constructed or were abandoned. A few of these 14 wells were decreed and the owners <br />have filed statements with the Water Court of their intent to abandon the water rights <br />diverted through these wells. <br /> <br />Data on monthly amounts of water pumped during the irrigation year 1994 (November <br />1, 1993 through October 31, 1994) was received from 1,526 wells. Data on monthly <br />amounts pumped during the irrigation year 1995 (November 1, 1994 to October 31, 1995), <br />was received on approximately 1,800 wells. <br /> <br />Enforcement of the 1994 Measurement Rules continues. As of February 1, 1996, <br />cease and desist orders were issued for 1,268 wells.
