<br />J OU12fi7 <br /> <br />Attachment No.8 <br /> <br />STATEMENT <br />To Be Submitted To The <br /> <br />WESTERN STATES WATER COUNCIL <br /> <br />Phoenix, Arizona <br />February 19, 1966 <br /> <br />Oregonians have long been cognizant of the value of water and <br /> <br />the need to conserve water to meet the requirements of an e~er- <br /> <br />growing economy and the full spectrum of multiplicity of uses. <br />Conservation was recognized on a statutory basis in the <br />Surface Water Code Oregon adopted in 1909. An integral portion of <br />this act provides: "Beneficial use shall be the basis, tbe measure <br />and the limit of all rights to the use of water in this state." <br /> <br />This sentence has been quoted on numerous occasions by the courts <br /> <br />and been defined as meaning that rights to the use of water shall <br /> <br /> <br />be for beneficial purposes without waste. An earlier statutory <br /> <br /> <br />reference upon this subject is contained in the following <br /> <br /> <br />quotation: <br /> <br />"Every corporation having constructed a ditch, canal or flume <br /> <br />under the provisions of the Act of 1891 shall carefully keep <br />and maintain the embankments and walls thereof and of any <br />reservoir constructed to be used in conjunction therewith so <br />as to prevent the water from wasting and from flooding or <br />damaging the premises of others. The corporation shall not <br />divert et any time any water for which it has no actual use <br /> <br />or demand." <br /> <br />Another major milestone that has resulted in conservation of <br /> <br />water was the enact.ment in 1939 of the act creating the State <br /> <br /> <br />Sanitary Authority which is empowered to establish standards of <br /> <br />water quality and to require and approve plans for treatment of <br />
