<br />294'i <br /> <br />-13- <br /> <br />Foremost and probably the most important to this s,ystem will be the disposal of <br />the No.2 Reservoir and its water rights. A definite proposition should be submitted <br />by the Bureau and accepted by this System to transfer the'place of diversion and stor- <br />age of the Reservoir to the Narrows site and in this connection the amount of water <br />that would be considered as the capacity of this reservoir. We should bear in mind <br />that this reservoir is susceptible of several fillings a year which has been accomp- <br />lished in the past and will be accomplished in the future. Future use of this reser- <br />voir .,lill probably be much greater in the future than it has in the past. Method of <br />acquisition of this reservoir and the ultimate consideration of the value and amount <br />of water for storage in the same must be determined. <br /> <br />A complete recognition should be made by the Bureau, not only of decreed priori- <br />ties for refill but vested rights to refill of reservoirs in accordance with the <br />present usage. In the event refill decrees for filings are made and adjudications <br />started for refill decrees "//e should have positive assuronce tllat the Bureau will not <br />in any way interfere, protest, contest, or otherwise'obJ8c~ to the entering of such <br />decrees. <br /> <br />We ask the protection of all of the Bijou ~ystem's irrigation works be guarante~ <br /> <br />We should have assurance that the ~inistration of any channel reservoir shall <br />be under the direct supervision of the ::;tate of Colorado oiater Officials. <br /> <br />The Bureau must give full recognition to the provisions of the contract between <br />the Bureau and the Northern Colorado Water Conservancy District relating to trans- <br />mountain water insofar as there is reserved by the United States for the use of the <br />Pistrict for domestic, irrigation and industrial uses, all of the increment seepage <br />!md return flow which may result from the construction of the project and the importa- <br />tion thereby from an extraneous source of a new and ample supply of water running into <br />the streams of the South Platte Water shed from which the irrigable land within the <br />district derive their water supply. That said captured, recaptured and return flow <br />'.ater shall be allocated only to the irrigable lands within the district already <br />being partially supplied with the water for irrigation, using as a basis for such <br />allocation the priorities existing at the date of that contract, and without other <br />or additional consideration or payments by the o\~ers of such lands therefore. <br /> <br />, ",'Ie strongly feel that the Bureau of Reclamation req,uest and obtain from the Con- <br />gress of the United States the right and permission to proceed with the adjudication <br />of any decree of any channel reservoir in the proper District Court of the proper <br />district within the State of Colorado so that said decree or decrees "hen adjudicated <br />may be administered by the State 'ciater Officials of the ::.tate of ColoradO in the same <br />manner as other decreed ,;ater rights in the State of C;o'.'):"ado. That after such per- <br />mission has been obtained any adjudication by the g;)V,,_ ,_,;",~,t shall be in the State <br />Courts. <br /> <br />Provision should be made by the Bureau that the un;; iiundred Sixty (HiO) acre <br />~tation not apply to any waters used for supplemental irrigation. <br /> <br />The recent (August 3rd and 4th, 1951) flood stages of the tributary stream of the <br />South Platte seem all the more to bring out the necessity for higher storage and also <br />
