<br />CO B-2 <br />C'i) <br />~ <br />..-.; <br />o <br />C) We 11 s as defi ned in Secti on 37-92-602, CRS 1973, such as those used for <br /> <br />domestic and stock watering, shall be exempt from the provisions of these rules <br />and regulations except for Rule III F. <br /> <br />B. The "Compact" referred to in these rules and regulations means the <br /> <br />Rio Grande River Compact, as specified in Section 37-66-101, CRS 1973. <br />C. The stipulation agreed to by Texas, New Mexico and Colorado before <br />the. United States Supreme Court in the case of Texas, et. al. v. Colorado, <br />Original No. 29, October term, 1966, of the Supreme Court and the resultant <br /> <br />. Order cited in 391 U. S. 901 (May 6, 1968) is that stipulation wherein the <br /> <br />the states agreed to a continuance of the case, providing in paragraph 1 as <br /> <br />follows: <br /> <br />"The State of Colorado undertakes to deliver water at the Colo- <br />radO-New. Mexico state line to. meet every year the delivery ob- <br />ligation established by the schedules of Article II of the Rio <br />Grande Compact. To this end the State of Colorado shall exercise <br />its best efforts and use all available administration and legal <br />pOwers including, if necessary, the curtailment of diversions <br />enforced by agents of the State. The State of Colorado shall make <br />frequent and regular reports to the plaintiffs of all measures taken <br />to effect compliance." (emphasis added) <br /> <br />D. In those instances where the Compact is deficient in establishing stan- <br /> <br />dards for administration within Colorado; the provisions of Section 37-80-104, <br /> <br />CRS 1973, which state as follows, shall be applicable: <br /> <br />ineer's duties. The state engi- <br />regulations with respect to de- <br />enable the state of Colorado to meet <br />its compact commitments. In those cases where the compact is <br />deficient in establishing standards for administration within Colo- <br />rado to provide for meeting its terms, the state engineer shall <br />make such regulations as will be legal and equitable to regulate <br />distribution among the appropriators within Colorado obligated <br />to curtail diversions to meet compact commitments, so as to re- <br />store lawful use conditions as they were before the effective date <br />of the compact insofar as possible." <br /> <br />E. The term "hydraul ic divide" means that ridge in the ground water table <br /> <br /> <br />which lies north of the Rio Grande in Colorado and which extends generally <br />
