<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Under conditions when the Keesee Ditch could take river flow in priority, <br />the releases from John Martin Reservoir would be reduced by the amount of <br />the Keesee Ditch depletion. This depletion amount would be determined as the <br />Keesee Ditch diversion rate minus the return flow obligation and the calculated <br />transi t losses. <br /> <br />The Keesee Ditch diversion rate will continue to be the decreed diversion <br /> <br />rates, to wit: <br /> <br />Priority Number 1 <br />Priority Number 4 <br />Priority Number 1918-4 <br /> <br />9.00 cfs <br />4.50 cfs <br />15.00 cfs <br /> <br />Transit losses and return flow obligations will be charged against these rates <br />to determine the depletion rate. The amount of the depletion would be transferred <br />to the Keesee account simultaneously with a reduction in the reservoir outflow. <br />In order for diversions to be made under this condition, a special exemption to <br />the John Martin Reservoir operating plan may be required. Under the current <br />operating plan, Article ll-C specifies that inflows be released through the reservoir <br />without accumulating any storage under summer flow through conditions. Under <br />an exemption from this policy, no injury would occur to downstream water users, <br />since the river flow would only be reduced by an amount equivalent to the <br />historical Keesee Ditch depletion. <br /> <br />(\ I. <br />rY i~ eO' ))/ <br />~/ //y/I <br />VI'-" <br /> <br />Diversion Limitations <br /> <br />In order to insure that the future use of the water right will not exceed <br />the historical pattern of use, short-term and long-term limitations on diversions <br />will be imposed. Monthly and seasonal limitations are based on the monthly <br />and summer season historical maximums as listed in Table III. Long-term use <br />of the water rights will be limited to a ten-year running total of diversions, which <br />is based on the historical average annual diversion. <br /> <br />-12- <br />
