<br />,8 <br />."'1 <br /> <br />r\,'l <br />CO <br />- <br />c.c <br /> <br />or biological activities until the Flood Control Act of 1965 (Public <br /> <br />Law 89-298, 89th Congress, S 2300) authorized and directed the Chief <br /> <br />of Engineers to use flood control space in the reservoir for that purpose. <br /> <br />This is for establishing and maintaihing a permanent pool for fish and <br /> <br />wildlife and recreational purpOSp.s and is not to exceed 10,000 acre-feet. <br /> <br />Storage space in the flood control pool however is to be used only <br /> <br />when storage space is not available within the conservation pool as <br /> <br />defined in Article III F, Arkansas River Compact (63 Stat. 145). <br /> <br />11. The storage and release of water for irrigation at the project <br /> <br />are in accordance with the Arkansas River Compact. Release of storage <br /> <br />from the flood control pool is at the discretion of the Corps of Engineers. <br /> <br />Before 1948 irrigation releases from John Martin Reservoir were very <br /> <br />irregular due partly to lack of agreement between the States of Colorado <br /> <br />and Kansas. A temporary agreement hetween the states was reached in 1948. <br /> <br />A final agreement in the form of a compact was signed by the two states <br /> <br />and ratified by the United States Congress in May 1949. Some of this <br /> <br />compact pertaining to storage and discharge at John Martin Dam is as follows: <br /> <br />Colorado and Kansas hereby agre~ upon the following hasis <br />of apportionment of the waters of the Arkansas River: <br /> <br />A. Winter storage in John ~Iartin Reservoir shall commence on <br />November 1st of each year and continue to and include the next <br />succeeding March 31st. During said period all water entering <br />said reservoir up to the limit of the then available conserva- <br />tion capacity shall be stored: Provided, that Colorado may <br />demand releases of water equivalent to the river flow, but <br />such releases shall not exceed 100 cubic feet per second and <br />water so released shall be used without avoidable waste. <br /> <br />5 <br />
