<br /> <br />(c) To obtain from water originating in Colorado <br />the highest duty for domestic uses and irrigation of <br />lands in Colorado within the terms of interstate <br />compacts. <br /> <br />(d) To co-operate with the United States under <br />the federal reclamation lows and other agencies. of <br />the United States government for the construction <br />and financing of works in the State of Colorado as <br />herein defined and for the operation and maintenance <br />thereof. <br /> <br />(e) To promote the greater prosperity and gen- <br />eral welfare of the people of the State of Colorado <br />.by encouraging the organization of woter conserv- <br />ancy districts os provided in this article. <br /> <br /> <br />'I <br /> <br />11 <br /> <br />11 <br /> <br />[I <br /> <br />150-5-3 JURISDICTION OF DISTRICT COURTS. The <br />district court sitting in and for any county in this <br />state of any judge thereof in vocation, is hereby <br />vested with iurisdiction, power and authority when <br />the conditions stated in section 150-5-4 ore found <br />to exist, to establish water conservancy districts which <br />may be en.tirely within or partly within and portly <br />without the judicial district in which said court is <br />located, for conserving, developing and stabilizing <br />supplies of water for domestic, irrigation, power, <br />manufacturing and other beneficial uses os herein <br />provided; provided that the terms of this article shall <br />not be construed to confer upon such district court <br />jurisdiction to hear, adjudicate ond settle questions <br />concerning the priority of appropriation of water <br />between districts organized under this article and <br />ditch companies and other owners of ditches drawing <br />water for irrigation purposes from the same stream <br />or its tributaries, and jurisdiction to hear and deter- <br />mine such questions of law and questions of right <br />growing out of or in C1ny way involved or connected <br />therewith, are expressly excluded herefrom and shall <br />be determined if'\. the proper CO\.ln1)' O~ otherWl~e <br />provided by the laws of the State of Colorado. <br /> <br />150-5.9 APPOINTMENT OF BOARD OF DIRECTORS <br /> <br />(1) (0) Within thirty days after entering the decree <br />incorporating said district, the court shall appoint a <br />board of directors of the district consisting of not <br />more than fifteen persons who are residents af the <br /> <br />4 <br /> <br />counties in which the water conservancy district is <br />situated, 011 of whom shall be the owners of real <br />property in said district. <br /> <br />(b) At the expiration of their respective terms <br />of office as fixed by the court, appointments sholl <br />be mode by said court for the term of two years. <br />the court shall fill all vacancies which may occur <br />on the board. Each director shall hold office during <br />the term for which he is appointed and until his <br />successor is duly appointed and has qualified, and <br />sholl furnish a corporate surety bond at the expense <br />of the district, in amount and form fixed Clnd ap- <br />proved by the court, conditioned for the faithful per- <br />formance of his duties as such director. <br /> <br /> <br />\~ '-. <br />150-5-10 ORGANIZATION OF THE BOARD OF <br />DIRECTORS <br /> <br />(1) Before entering upon hi5 official du1ies eac.h di- <br />rector shall take and subscribe to an oath before an <br />offic.er authorized 10 administer oaths, that he will <br />support the constitution of the United States and the <br />State of Colorado and will honestly, faithfully, and <br />impartially perform the duties of his office and that <br />he will not be interested directly or indirectly in any <br />contract let by said district, which oath shall be filed <br />in the office of the clerk of said court in the original <br />case. <br /> <br />(2) Upon taking the oath, the board sholl choose one <br />of their number chairman of the board and president <br />of the dis.trict, and shall elect some suitable person <br />secretary of the board and of the district, who may <br />or may not be a member of the board. Such board <br />shall adopt a seal and keep in a well-bound book a <br />record of all of its proceedings, minutes of all meet- <br />ings, certificates, contracts, bonds given by employees <br />and all corporate acts which shall be open to in- <br />spection of all owners of property in the district, as <br />well os to all other interested parties. <br /> <br />(3) Each member of the board sholl receive as com- <br />pensation for his service such sum os sholl be ordered <br />by the court, not in excess of the sum of five hundred <br />dollars per annum, payable monthly, and necessary <br />tra....eling expenses actually expended while engaged <br />in the performance of his duties. <br /> <br />5 <br />
