M. C. Hinderlider

-2-

May 24, 194.3

~
It

---
Ft. Lyon and others opened ~p-_ ihr~tuiays-later-and-the-flO1!'-jj\to-tlle reservoir soon
-dropped-to-arouno.-SO- second feet. If that continues, Colorado's diversions out
of surplus account may amount to nearly 30,000 acre feet in May. In that case it
will take a ~ge actual IJ1U'plus to compenaate for these quaIltities and permit the
delivery to Kansas at the State line of an equivalent amount in addition to "status
quo. deliveries. In view of 'these figures, I wish also to 1ll8ke a complete check of
diversions in April as soon as it is possible to do so.

C_)
'.:.\

N
~
.
i--'

You will note that in the attached tabulation I have set forth the com-
puted excess diversions qy ditches above the reservoir in detail as to each ditch,
e.nd by days. Your office probably does the same in making its computations. I
believe it would be he~pf'ul to me in checking any figures if your caJ.culations
could be given me in detail instead of merely a total quantity for a given period.

-;

Commenting on your statement that, "It is my understanding that ;you were
of the opinion that it: this were done, Kansas would have no objection to such addi-
tional diversions above the reservoir.., I believe we can say that Kansas does not
expect to dictate the use of lIater in Colorado, but if Colorado diverts large
amounts of 'llater out of surplus, or out of anticipated surplus, we will expect -it
to hold a like amount for delivery to KaIlaaa on our request.

I have discuased the contents of this letter with the Assistant Attorney-
General, Mr. W.ll;ngford, and he is in accord with what I have written.

I

Yours very truly,

__U A J/ . /'
~/~'i/'~

Geo. s.
