Signs and Board Membersl <br /> <br />On behalf of SilverCreek Holding Company ("SilverCreek"), I <br />am writing to express its concerns about the potential effect of <br />the 9SCW296 and 9SCW297 applications upon colorado River water <br />users and Silvercreek specificallY, and to request the Colorado <br />River Water Conservation District to assist the water users. <br />silvercreek isa party objector in these cases. AS you are <br />aware, these applications (when and if decreed) will allow the <br />Colorado Water Conservation Board (CWCB) to control all the <br />remaining "unappropriated" water in the river basin. " <br />.NOV 2 7 1996 <br /> <br />COLrJj~r"."I:t', ....".. <br />COH3eBlA TX>I i)I6 TIlle I <br /> <br />SilverCreek requests the River District to take an active <br />role in these cases to evaluate the need (if any) for the filings <br />claimed and to Dressure the United States Fish and Wildlife <br />Service ("service-) to confirm that the decrees entered will <br />avoid Section 7 consultations. silverCreek believes CRWCD is the <br />best positioned governmental entity to raise and establish a <br />physical or biological "defense" to the 95Cw296 and 95CW297 <br />appropriations. ' <br /> <br />SilverCreek has been advised of several legal defects which <br />may prevent or limit the CWCB'B claimed appropriations, but it is <br />still disturbed by what it perceives is a thin biological basis <br />for the claimed flows. The CWCB and Service seek to persuade <br />other water users that the base flow (95CW297) and recovery flow <br />(95CW296) will promote recovery of the endangered fish, but they <br />have not provided the objectors with any conclusive evidence to <br />this effect. The Service and cweB have thus far failed to <br />address the exotic fish competition question and prove the <br />
