<br />MISSOURI RIVER BASIN STATE POSITION <br /> <br />Presented to the Ad Hoc Committee on Water Marketing <br />June 5, 1974 <br />Ramada Inn, Smith Road <br />Denver, Colorado <br /> <br />The long-range policy matters related to the water marketing should be referred <br />to the t.li ssouri Ri ver Bas i n Commi ss i on for study and recommenda ti on; that in <br />the interim period individual states should work with Federal agencies to <br />resolve the immediate problems. The following principles shall be used as guide- <br />lines in resolving these immediate problems. Should there be any contemplated <br />deviation therefrom, such state should so notify the 10 r1issouri River Basin <br />state representatives. <br /> <br />1. For the purpose of these discussions we are considering only heavy indus- <br />trial water users (5,000 AF/yr or greater consumptive use ). <br /> <br />2. Any actions of the federal agencies relative to marketing water for indus- <br />trial use in the Missouri River Basin shall follow state law and require <br />as a condition precedent that the water user entering into any contract <br />with the federal government for surplus \1ater obtai n a state \'Iater permi t. <br /> <br />3. The state shall have the first right of refusal to market available ~Iater <br />supplies. <br /> <br />4. Applications for industrial water supply pending before federal agencies <br />for water from federal reservoirs in Hontana for use exclusivel'y within <br />"the'state'shall be suspended untiT an agreem~nt is hegoti~ted with the <br />State of Montana. <br /> <br />5. User charges for industrial I-later shall be determined by the state except <br />in those cases where the state decides not to be the marketing agent. <br /> <br />6. Charges for industrial water at the federal level should be only that <br />amount required to compensate the basin account for revenue foregone. <br />
