<br />r;...: '~.., <br /> <br />-..-....., <br /> <br />( "J J, <br />hJ L ~ <br /> <br />~':.':' .. : <br /> <br />Green Mountain Reservoir's refill right (6,316 acre-feet) was exer- <br />cised in 1977, and 1,105 acre-feet of water was stored during the <br />period from July 24 through July 28. <br /> <br />During Water Year 1977, Green Mountain Reservoir reached a mlnlmum <br />storage content of 74,500 acre-feet on April 12, and a maximum storage <br />content' of 124,000 acre-feet on June 28. <br /> <br />The theoretical fill of Green Mountain Reservoir, as computed on <br />the Bureau of Reclamation's Colorado River Accounting Sheets, would <br />have occurred on June 28, if 28,622 acre-feet of water stored out <br />of priority in Denver's Dillon Reservoir pursuant to the April 1964 <br />Stipulation were included. However, when the Bureau of Reclamation <br />requested Denver to begin releasing the water on July 25 at a rate <br />of 325 ft/s, the Denver Water Board refused. Denver claimed a right <br />to the water if it was willing to pay power interference. <br /> <br />On July 18, the Colorado River Water Conservation District filed <br />a Motion requesting that Denver be required to release the 28,622 <br />acre-feet and that this matter be heard at the July 20, 1977, hearing, <br />which was scheduled to consider the matter of a proposed partial <br />remand to State Court of certain issues. At the hearing on July 20, <br />1977, Judge Alfred Arraj declined to hear the dispute and, instead, <br />set the matter down for hearing on August 29, 1977. Pending the <br />hearing on August 29, 1977, an interim stipulation was executed <br />on July 29, 1977. Paragraph 5 of this interim stipulation states: <br /> <br />"Denver agrees that should the Secretary of Interior <br />require the release of water from Green Mountain <br />Reservoir under his interpretation of the decree of <br />of this court which would reduce the water in storage <br />in Green Mountain Reservoir below 73,000 acre-feet, Denver <br />will then on request of the Secretary or his authorized <br />representative make sufficient releases from Dillon <br />Reservoir in whatever amount is necessary to hold said <br />Green Mountain Reservoir stored water to an amount of <br />73,000 acre-feet, but not to exceed releases in excess <br />of 28,622 acre-feet, until after some disposition of this <br />matter by the court on August 29, 1977, no impairment <br />of the reservoir being anticipated if the water in <br />storage there is kept to an amount of 73,000 acre-feet." <br /> <br />On September 6, 1977, the storage in Green Mountain Reservoir was <br />72,800 acre-feet. The Bureau of Reclamation, representing the Secretary <br />of the Interior, then requested the Denver Water Board to initiate <br />a release from Dillon Reservoir.
