This MeA becomes effective on the date entered into. <br />This agreement shall terminate by reason of anyone of the fol- <br />lowing occurrences: <br /> <br />a. The united States, acting through the Secretary <br />of the Interior, has declared that the listed species in the <br />Upper Colorado River Basin are extinct; or <br /> <br />b. The United States, acting through the Secretary <br />of the Interior, has removed the listed species in the Opper Col- <br />orado River Basin from the endangered or threatened species list <br />and determined that the instream flows that are the subject of <br />this MeA are no longer needed to prevent the species from being <br />relisted under the Endangered Species Act; or' <br /> <br />e.
