RtGHTS <br /> <br />TO: <br /> <br />JeJ 8GG 4474 <br /> <br />~PR 21. l~~J 12:20PM R43G p.es <br /> <br />Colorado, Wyoming, and Utah; the Service; the U.S. Bureau of <br />Reclamation; the Western Area Power Administration; water <br />resource development organizations; and environmental organiza- <br />tions developed and agreed to the Recovery Implementation Program <br />for Endangered Fish Species in the Upper Colorado River Basin <br />(Implementation Program); and <br /> <br />WHEREAS, the purpose of the Imolementation ProQram is to <br />recover the endanaered fish whlle prov~ding for wacer development <br />to continue ana croceed in the Uncer Colorado R~ver BaSin ~n ac- <br />cardance with lnterstaee compacts and federal and state law; and <br /> <br />WHEREAS, one element of the Implementation Program, S 4.1, <br />involves identifying the endangered fish species' flow require- <br />ments and acquiring or appropriating water or water rights to <br />provide those flows in a manner consistent with all state laws; <br />and <br /> <br />WHEREAS, 5 4.1.3.c.l of the Implementation Program specifi- <br />cally states: <br /> <br />ADMINISTRATION OF INSTREAM FLOWS IN COLORA- <br />DO: The State of Colorado has in place a <br />law that allows for the appropriation and <br />acquisition of water rights to preserve the <br />natural environment tc a reasonable degree <br />[Colo. Rev. Stat. 37-92-1Q2(3)]. Instream <br />flows for stream segments within the State <br />of COlorado, including those supplied by <br />Ruedi and Blue Mesa Reservoirs for instream <br />purposes, will be appropriated and acquired <br />by' the Colorado Water Conservation Board <br />pursuant to the proceaural and substantive <br />requirements of State law. The Secretary <br />will recommend the appropriation and acqui- <br />sition of instream flow water rights, and <br />the ways and means of doing so, to the Col- <br />orado Water Conservation Board. <br /> <br />It is anticipated that the Secretary and <br />the Board will execute an agreement to bet- <br />ter define their respective responsibili- <br />ties under this program. Such an agre~ment <br />will provide that the Secretary and the <br />Board will work together in good faith to <br />carry out the terms of this program. <br /> <br />and <br /> <br />-3- <br />
