SECTION 6:

Land Acquisition

6.1 Must the land area of islands be included in the calculation of the
100 acres per mile fee title limitation?

No. The acreage limitation of section 6(a) applies only to those
uplands extending back from each side of the river, Island acreage
need not be included in calculating the acreage limitation.

6.2

Federal fee ac uisition

The limitation applies to all rivers listed in section 3 and any
rivers subsequently added to the National System unless specifically'
exempted in the authorizing legislation. (February 7. 1969)

. 6.3 Does section 6(a) limit the fee acquisitions on State rivers included
in the National System?

No. Section 6(a) is a limitation on federal land acquisition activi-
ties only. It is not applicable to State activities with respect to
State rivers included in the system under the criteria of section 2(a).

6.4 Section 6(b) prohibits Federal acquisition of lands by condemnation if
50 percent or more of the entire acreage within a federally admin-
istered area "". is owned by the United States. by the State or States
within which it lies. or by political subdivisions of those Sta~es.~
Does this limitation anply to 50 percent ownershin by only one of these
three jurisdictions, or does it refer to combined ownership?

Federal condemnation for full title is suspended whenever the cumula-
tive public ownership exceeds 5O~. (February 7, 1969)
