U.S. Fish and Wildlife Service, <br />Denver, Colorado <br /> <br />Subject: Final Biological Opinion for the Wolford Mountain Reservoir Project <br />(formerly the Muddy Creek Reservoir Project), Grand County, Colorado <br /> <br />In accordance with section 7 of the Endangered Species Act of 1973, as <br />amended (16 U.S.C. 1531 et seq.). and the Interagency Cooperation Regulations <br />(50 CFR 402), this transmits the Fish and Wildlife Service's final biological <br />opinion for impacts to federally listed endangered species for the Wolford <br />Mountain Reservoir Project. Copies of this opinion should be provided to the <br />applicant because the Service has incorporated reasonable and prudent <br />alternatives that should be included as conditions of any permits issued by <br />the Bureau of Land Management for this project. <br /> <br />Reference is made to your May 23 and July 18, 1997, correspondence requesting <br />initiation of formal consultation for the subject project. The Service <br />concurs with your no affect determination for bald eagle (Ha1iaeetus <br />leucocephalus) , AstraGalus osterhoutii (Osterhout milk-vetch), and Penstemon <br />penlandii (Penland beardtongue). However, the Service does not concur with <br />your no affect determination for the endangered Colorado squawfish <br />(Ptychocheilus lucius), humpback chub (Gila ~), bony tail (Gila elegans), <br />and razorback sucker (Xyrauchen texanus) and their critical habitat due to the <br />water depletion from the upper Colorado River basin. <br /> <br />CONSULTATION HISTORY <br /> <br />On February 7, 1990, the Service issued a biological oplnlon for the Muddy <br />Creek Reservoir Project, now called Wolford Mountain Reservoir.
